License Agreement for West Wind WebSurge

West Wind WebSurge comes in several license modes:

• Evaluation
• Single User Personal
• Single User Professional
• Multiple User Professional
• Site License

West Wind WebSurge is a licensed product. A fully functional evaluation version to check out WebSurge's features and usage, is available, but commercial, non-profit, government and continued personal use requires purchase of a license.

Evaluation License

The evaluation version is unrestricted and has all the features and functionality of the professional version, but shows occasional pop-up notices in the user interface.

Tampering with or removing of the notice is not allowed for this evaluation version.

IMPORTANT: Licenses are activated and occasionally re-validated over the Internet, so an Internet Connection is Required for using WebSurge in licensed mode.

Personal License

For continued use of WebSurge for individual users in a non-organizational environment, a personal license is available. This discounted license is fully featured, but it is limited to small developers and single propriertors with income of us$75k or less. The fully licensed version of WebSurge removes the occasional notices and provides access to all features without limitations.

Each licensed user must have a separate license, but a single user may use multiple copies of West Wind WebSurge on multiple machines, given that only one copy at a time is in use.

Professional License

For continued use of WebSurge for commercial use a personal or professional license is required. The fully licensed version of WebSurge removes the occasional notices and provides access to all features without limitations as well as access to some of the online features.

Each licensed user must have a separate license, but a single user may use multiple copies of West Wind WebSurge on multiple machines, given that only one copy at a time is in use.

Multiple License Packs

In additional to the single personal and professional licenses, you can also purchase various license packs at a per license discount. These multi-user packs are valid for multiple users within an organization. A site license that allows unlimited use within a business organization is also available.

License Updates and Upgrades

Any purchased license is valid for the duration of the major release that it was purchased for (ie. 2.0-2.99). Same version updates of minor versions are always free. You can just download the latest version and your license is automatically applied to the new minor version.

Upgrades are available for major version upgrades (ie. v2 → v3), usually at around 50% of the full new version price for the given product. It's our policy to allow for free upgrades to the next major version within one year of purchase of a previous version.

For ugprades of license packs or site license contact us directly and we'll provide you with a custom upgrade code to discount purchase of a new license.

Please note that all upgrade requests are manually reviewed and authorized, so it might take up to full day to process an upgrade order.

Free Upgrades for v2 Licenses Purchased after Mar 1st,2023

Until the end of 2024 we offer free upgrades to v3 for any v2 licenses purchased on or after Mar 1st, 2023. You can place a no-charge upgrade order, and we'll process it manually after review to ensure you qualify for the ugprade. If you're using the same account as the original purchase there's nothing else to do. Otherwise please provide previous version license or purchase information in the order notes.

Contributors that provide valuable feedback, help out with code/PRs, actively promote West Wind WebSurge or support WebSurge in any other significant way are eligible for a free license (at our discretion).

Microsoft MVPs and Microsoft Employees get free Licenses

If you are a current Microsoft MVP or Insider, a Microsoft employee, or an employee of a company that offers free tools to Microsoft MVPs you qualify for a free license. Basically I want to give back to those that have given to the community and shared their knowledge or work. I'll consider anybody who has given back to the community as well as anybody actively involved in the Open Source community for a free license.

Source Code Access

Due to rampant abuse of the original publicly accessible repository, public source code access is no longer available. WebSurge source code is now available on a per request basis in a private GitHub repository, but you can request access to the private repository.

Under no circumstances are you allowed to re-package or re-distribute any part of West Wind WebSurge outside of your organization. Source code is provided solely for helping to improve West Wind WebSurge, or for internal use in your organization.
